Terms of service

These terms cover your use of pewterpixel.com and, together with a signed service agreement, the web design and hosting plans sold by Offensive Threads LLC d/b/a Pewter Pixel (“Pewter Pixel,” “we,” “us”). If a signed service agreement says something different about a project, the agreement wins for that project. These terms win for use of this marketing website.
Sending a contact form, or booking a consult, does not start a paid plan. Paid work begins only when both sides have agreed in writing — including the fee, what’s included, and how either side can end it.
The marketing website
You may browse this site and share links to it. You may not copy the design, text, or mark for your own studio, scrape it in bulk, or interfere with how it is hosted. The Pewter Pixel name and logo belong to Offensive Threads LLC.
The fees on the pricing page are the current prices. A signed service agreement names your plan, the monthly fee (including a founding rate, if one applies), the setup choice, and the term. Paid work begins when that agreement is signed.
The monthly plans
A Pewter Pixel plan is a subscription for a custom website and the care around it. Hosting is included on every plan, along with SSL, speed monitoring, and the edit allowance for that plan. There is not a separate hosting bill. The agreement lists the page count and whether Growth includes optional self-editing.
An edit is one change to existing content on one page, taking up to 30 minutes. That covers text, photos, hours, and prices. New pages, new sections, and new features are add-ons, priced before the work. Unused edits do not roll over. Request an edit by email or the contact form. We complete it within 2 business days, or within 1 business day on Growth.
You provide a logo, photos, and a service list within 14 days of signing. Launch includes 1 round of design revisions, or 2 rounds on Growth.
Setup is $0 when you agree to a 6-month minimum, or $249 if the plan is month-to-month from the start. After the minimum, the plan continues month-to-month and either side may end it with 30 days’ notice. Prepaying a year costs ten months’ fees — two months free — which is $390 on Starter, $690 on Local Pro, and $1,290 on Growth.
The first 10 clients may lock a founding rate of $29, $59, or $99 a month, matching Starter, Local Pro, and Growth, for as long as they stay subscribed. Founding setup is $0, and the first charge is on launch day. In exchange, the client agrees to a Google review, a testimonial, permission to feature the site as a sample, and a small “Site by Pewter Pixel” footer credit. A referral that stays three months earns the referring client one free month.
Add-on prices are listed on the pricing page. An online store, client logins, or a custom integration is quoted separately, in writing, before that work starts. Third-party products embedded on the site (for example a scheduler) may charge their own fees, paid by you to that company.
A domain is registered at cost, in your name. You keep the domain and your Cloudflare account if you leave.
Your content and ownership
You keep ownership of the content you provide: words, logos, and photos you have the rights to. You promise that you have those rights, and that the material is accurate where a customer might rely on it — licenses, prices, professional credentials, and similar facts. We will not invent reviews, awards, or credentials.
While your plan is active and in good standing, we host the site. If the plan ends, we provide the content you gave us at no charge. The site code transfers at no charge after 12 months of paid service, or for $299 before that. Studio tools that were not built as your site stay with us.
You grant us a license to use the materials you provide solely to build, host, show you previews, and maintain the site, and to show the finished work in our portfolio unless you ask us in writing not to.
Your responsibilities
- Give us timely feedback and the facts the pages need
- Keep your own login details private if an editing screen is part of your plan
- Review pages before they go live, including anything a customer or regulator might rely on
- Use the site lawfully, and don’t ask us to publish content that infringes someone else’s rights
Acceptable use
You may not use a site we host, or this marketing site, to:
- Break the law or help someone else break it
- Distribute malware, or probe networks without permission
- Send spam or host phishing
- Publish material that infringes copyright, trademark, or privacy rights
We may refuse or remove content that creates legal risk, and we may suspend hosting if a site is being used this way. If we can, we’ll tell you first. If the issue is urgent — malware, a credible threat, a court order — we may act and then tell you.
If you believe a site we host infringes your copyright, email hello@pewterpixel.comwith the page address, a description of the work, and your contact details. We will review good-faith notices.
Hosting and availability
Client sites on a Pewter Pixel plan are static and hosted for speed and a smaller security surface. We aim for them to stay online, and we keep backups so we can restore from a bad edit or an incident. We do not promise uninterrupted service. Maintenance, host outages, domain problems, and events outside our control can take a site offline for a time. We will work to restore it within a reasonable period once we know.
We do not guarantee a Google ranking, a map position, a revenue figure, or a particular amount of traffic. We do build static pages with performance in mind, and we’ll tell you if a photo or embed is likely to slow the site down.
Fees, term, and cancellation
Fees and the term are the ones on the pricing page and in the service agreement. Until that agreement is signed, nothing on this website obliges either side to pay or to perform. After any minimum term, you may cancel with 30 days’ notice. A plan with $0 setup has a 6-month minimum. A plan that paid the $249 setup is month-to-month from the start, still with 30 days’ notice. On cancellation in good standing — fees paid through the notice period — we provide your content at no charge, and the code transfers on the terms above. We don’t hold your words as leverage.
If a payment is 15 days past due, we pause the site. It returns when the balance is paid, except where the host or a legal order forces a faster action.
Disclaimers
This marketing website is provided as-is. Consultations are conversations, not professional advice in law, medicine, accounting, or any other licensed field. Page copy we draft with you is not a substitute for your own review of anything a customer might rely on.
Except where the law says otherwise, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we don’t warrant that the site will be error-free.
Limitation of liability
To the fullest extent the law allows, Offensive Threads LLC is not liable for indirect, incidental, special, consequential, or lost-profit damages, or for loss of data beyond what a recent backup can restore. Our total liability for a claim arising out of a plan is limited to the fees you paid us for that plan in the three months before the claim. These limits don’t apply where the law forbids them, including liability for our gross negligence or willful misconduct.
Your materials
If a third party brings a claim because of content you provided, or because of how you used the site, you will cover the studio’s reasonable damages and costs arising from that claim, except to the extent the claim was caused by our own changes made without your content or instruction.
Governing law
These terms are governed by the laws of the State of Florida, excluding conflict-of-law rules. Courts located in Hillsborough County, Florida, or the federal courts that cover that county, are the venue for disputes, and each side consents to personal jurisdiction there. Either side may still seek injunctive relief for misuse of intellectual property.
Other terms
If a court holds one part of these terms unenforceable, the rest stays in effect. Our failure to enforce a provision once is not a waiver. You may not assign a plan without our written consent. We may assign these terms in connection with a reorganization of Offensive Threads LLC.
We may update these terms by posting a new version on this page with a new date. For active clients, a change that reduces what a signed plan includes does not apply to that plan unless you agree.
